释义	法律分析：行政处罚择一从重原则是指行政处罚有个原则叫“择一从重”原则，就是说在行政执法检查中，发现一个相对人存在多个违法行为，只能选择一个违法程度较重的进行处罚。从重处罚是指行政机关在法定的处罚方式和幅度内，对行政违法行为人在数种处罚方式中选择较严厉的处罚方式或者在某一处罚方式允许的幅度内选择上限或者接近于上限进行的处罚。法律依据：《中华人民共和国刑法》第六十二条犯罪分子具有本法规定的从重处罚、从轻处罚情节的，应当在法定刑的限度以内判处刑罚。
