释义	法律分析：如果是质量问题，而开发商没有将楼盘移交给物业或者还在保修期内，则不能要求物业承担责任；如果如果过了保修期且是公共区域漏水，可要求物业公司承担责任；但是如果公共区域漏水而不在物业服务合同规定的物业服务义务范围内的，则不能要求物业承担责任；如果非质量问题，而是楼上漏水，则应向楼上业主主张权利。法律依据：《房屋建筑工程质量保修办法》第七条在正常使用下，房屋建筑工程的最低保修期限：屋面防水工程、有防水要求的卫生间、房间和外墙面的防渗漏，为5年。
