一、民法典中小产权房有房产证吗
小产权房一般是不具有房产证的，但有些人补办相关手续后，可以申请对小产权房办理房屋产权登记，办理产权登记后，取得房产证。
《中华人民共和国民法典》
第二百零九条【不动产物权登记的效力】不动产物权的设立、变更、转让和消灭，经依法登记，发生效力;未经登记，不发生效力，但是法律另有规定的除外。
依法属于国家所有的自然资源，所有权可以不登记。
第二百一十一条【不动产登记申请资料】当事人申请登记，应当根据不同登记事项提供权属证明和不动产界址、面积等必要材料。
二、小产权房拆迁可以获得哪些补偿
实际中，合法建成的小产权房，不管是否已经进行交易，被依法纳入征收拆迁范围的，即可以获取相应的补偿。
具体而言，小产权房拆迁时可以要求安置居住房，同时有关搬迁补助、装修补偿等补偿。
并且，根据补偿的范围，房屋拆迁补偿的计算标准如下：
1、房屋拆迁补偿计算标准
(1)房屋拆迁货币补偿=合法拥有房产评估价格+房屋装修装饰商定补偿金额(或经评估确定的房屋装修装饰补偿金额)。
(2)房屋拆迁补偿差价=合法拥有房产评估价格+房屋装修装饰商定补偿金额或经评估确定的房屋装修装饰补偿金额)-被拆迁人获得调换产权的房屋的评估价格。
2、房屋拆迁安置费计算标准
被拆迁人房屋拆迁安置费=搬迁补助费+没有提供周转房情况下的临时安置补助费+超过过渡期限的临时安置补助费+非住宅房屋因停产、停业造成的损失赔偿费。
