新交通法上没有关于流动测速的规定，但是在《道路交通安全违法行为处理程序规定》规定了移动测速的规定，移动测速设备由交警操作。
法律依据：
《道路交通安全违法行为处理程序规定》 第十七条 使用固定式交通技术监控设备测速的路段，应当设置测速警告标志。使用移动测速设备测速的，应当由交通警察操作。使用车载移动测速设备的，还应当使用制式警车。
