释义	法律分析：原告可以撤销案子，申请人必须是原告、上诉人及其法定代理人，经原告特别授权的诉讼代理人也可以提出撤诉申请。有独立请求权的第三人也可以提出撤诉申请，但不得影响原告和被告之间的诉讼正常进行。法律依据：《关于适用〈中华人民共和国民事诉讼法〉若干问题的意见》第一百四十四条当事人撤诉或者人民法院按撤诉处理后，当事人又以同一诉讼请求再次起诉的，人民法院应予受理。因此，一般情况下，撤诉后又起诉的没有时间间隔限制。但离婚案件比较特殊，没有新情况新理由的，要求间隔六个月才能再次起诉。
