释义	法律分析：行政诉讼中，一般情况下，原告撤诉后又以同一理由再起诉的，根据一事不再理专的原则，法院属不会受理。但如果撤诉不是出于原告的真实意愿，那么原告可以向人民法院申请再审，法院将原裁定撤销后才能对原诉重审。法律依据：《最高人民法院关于执行若干问题的解释》第三十六条人民法院裁定准许原告撤诉后，原告以同一事实和理由重新起诉的，人民法院不予受理。准予撤诉的裁定确有错误，原告申请再审的，人民法院应当通过审判监督程序撤销原准予撤诉的裁定，重新对案件进行审理。
