释义	法律分析：代购不等于犯法，需要把握一定的限度。有两种形式的代购是合法的：一种是本人从国外购买不超过一定价值和数量的物品，供自己使用或馈赠亲朋；另一种是专门的代购商家进行代购，但这些商家的物品是按法律交税的。法律依据：《中华人民共和国海关法》第四十三条海关可以根据对外贸易经营者提出的书面申请，对拟作进口或者出口的货物预先作出商品归类等行政裁定。进口或者出口相同货物，应当适用相同的商品归类行政裁定。海关对所作出的商品归类等行政裁定，应当予以公布。
