释义	口头协议有效。法律规定订立合同的形式有两种:第一种是口头形式,第二种则是书面形式。以口头形式订立的协议或者合同,只要是出于双方的真实意思表示则为有效的。但如果是保证合同就不一定了。法律规定保证合同应采用的形式。当事人口头保证不具有法定形式，不具有保证合同效力。因此，口头保证没有法律效力。
