法院不予执行的情形

释义

法律主观：

法院不予受理刑事自诉的情形是：已过追诉时效的自诉案件。被告人已经死亡或者下落不明的。不属于自诉案件的。自诉人撤诉后就同一事实又起诉的，但因证据不足撤诉的情况除外。法院调解结案后自诉人又反悔提起诉讼的。民事案件结案后，自诉人就同一事实再行提出刑事自诉的。

法律客观：

根据《民事诉讼法》第一百二十三条：符合起诉条件的，应当在七日内立案，并通知当事人；不符合起诉条件的，应当在七日内作出裁定书，不予受理；原告对裁定不服的，可以提起上诉。
