释义	法律分析：应劳务方和承包方（申请人）的请求，银行金融机构向工程的业主方（受益人）做出的一种履约保证承诺。如果劳务方和承包方日后未能按时、按质、按量完成其所承建的工程，则银行将向业主方支付一笔约占合约金额5%~10%的款项。法律依据：《中华人民共和国招标投标法》第四十六条招标人和中标人应当自中标通知书发出之日起三十日内，按照招标文件和中标人的投标文件订立书面合同。招标人和中标人不得再行订立背离合同实质性内容的其他协议。招标文件要求中标人提交履约保证金的，中标人应当提交。
