| 释义 |
法律分析：1、劳动者在事假期间，用人单位可以不支付其工资。
2、劳动者生育或者施行计划生育手术依法享受休假期间，用人单位应当支付其工资。
3、劳动者因产前检查和哺乳依法休假的，用人单位应当视同其正常劳动支付工资。
4、劳动者在工作时间内依法参加社会活动，或者担任集体协商代表履行代表职责、参加集体协商活动期间，用人单位应当视同其正常劳动支付工资。
5、劳动者依法享受年休假、探亲假、婚假、丧假等休假期间，用人单位应当支付其工资。
6、劳动者被人民法院判处管制或者拘役适用缓刑、有期徒刑适用缓刑或者被假释、监外执行、取保候审期间，用人单位未与其解除劳动合同，劳动者继续在原单位正常劳动的，用人单位应当按照劳动合同的约定以及本单位规章制度的规定支付其工资。
7、用人单位因生产经营困难暂时无法按时支付工资的，应当向劳动者说明情况，并经与工会或者职工代表协商一致后，可以延期支付工资，但最长不得超过30日。
法律依据：《劳动部关于贯彻执行〈中华人民共和国劳动法〉若干问题的意见》第59条:“职工患病或非因工负伤治疗期间，在规定的医疗期间内由企业按有关支付其病假工资或疾病救济费，病假工资或疾病救济费可以低于当地最低工资标准支付，但不能低于最低工资标准的80%。”
