释义	协议免责，是指当事双方协商一致，达成免除一方或者双方责任的结果的行为。是当事人意思自治的表现。在我国，协议免责并不适用于所有的责任范围，一般仅限于民事和行政责任。刑事责任不能协议免除。同时免责条款不能违背与我国现行的法律法规中的强制性规定。法律依据：《中华人民共和国民法典》第五百零六条：合同中的下列免责条款无效：（一）造成对方人身损害的；（二）因故意或者重大过失造成对方财产损失的。
