释义	合法，若仅只是名称与所盖公章不一致的情形合同有效，以签章的主体为合同主体。一般情况下，按盖章处名称执行，因为，在合同生效条款处都是约定盖章或签字生效，所以，谁盖章谁承担履行责任。特殊情况下，委托他人代签合同时，盖章处的单位实际是受托人，根据委托合同关系，受托人的行为，由委托人承担，合同仍然由实际委托人承担履行责任，对此，应由相关证据予以支持才行。法律依据：《中华人民共和国劳动合同法》第三十三条用人单位变更名称、法定代表人、主要负责人或者投资人等事项，不影响劳动合同的履行。
