释义	生活中，周岁不同于虚岁，虚岁往往是从出生的那年就开始算一岁了，而在法律上周岁怎么算呢？法律上的只是有关于周岁的界定，一般认为过完生日就是一个周岁。即出生时为0周岁，出生第二年的公历生日那天过完，即生日的第二天零时起，就开始为1周岁，以此类推。《最高人民法院关于审理未成年人刑事案件具体应用法律若干问题的解释》第二条明确规定，“周岁”，按照公历的年、月、日计算，从周岁生日的第二天起算。这是我国法律对周岁计算方式的明确规定，公信力很高，所以可以作为我国计算周岁的标准。
