释义	法律分析：第二十三条，犯罪未遂，是指已经着手实行犯罪，由于犯罪分子意志以外的原因而没有完成犯罪的行为状态。犯罪未遂的行为人是未遂犯。“着手”标志着犯罪预备阶段结束，行为进入犯罪实行阶段。犯罪尚没有着手实行就停止下来，那就不可能有犯罪未遂形态，只可能是犯罪预备或者犯罪预备阶段的犯罪中止。法律依据：《中华人民共和国刑法》第二十三条已经着手实行犯罪，由于犯罪分子意志以外的原因而未得逞的，是犯罪未遂。对于未遂犯，可以比照既遂犯从轻或者减轻处罚。
