问题	没有过户车肇事原车主负责吗
释义	已经买卖并实际交付但未过户的，发生交通事故原车主无需担责。只要车主已经与买受方签订车辆转让协议，证明车辆已经转让并交付给买受方，买受方在使用车辆时发生交通事故的，作为车辆出让方的车主不需要承担赔偿责任。车辆登记过户属于行政管理行为，并非法律意义上的所有权转移，车辆买卖从交付时就已发生所有权转移的法律效力。因而，发生交通事故应由实际支配车辆运行或者取得运行利益的一方承担损害赔偿责任，作为原登记所有人不应再承担损害赔偿责任。该内容由严达兴律师和法律部落共创回答
