释义	法律分析：国有林场可以转让和承包的，但必须经过公开拍卖，经过有关部门批准后才能转让和承包。只能转让规定期限的林地林木使用权，其所有权不能转让。法律依据：《林地管理暂行办法》第一条为了加强林地的保护、管理和合理利用，根据《中华人民共和国森林法》和有关法规，制定本办法。第二条本办法所称林地，包括郁闭度0．3以上的乔木林地，竹林地，疏林地，灌木林地，未成林造林地，采伐迹地，火烧迹地，苗圃地和国家规划的灾林地。
