释义	法律分析：最高人民法院《关于人民法院审理离婚案件如何认定夫妻感情确已破裂的若干具体意见》第3条规定：婚前隐瞒了精神病，婚后经治不愈，或者婚前知道对方患有精神病而与其结婚，或一方在夫妻共同生活期间患精神病，久治不愈的，视为夫妻感情确已破裂。一方坚决要求离婚，经调解无效，可依法判决准予离婚。据此规定，配偶患有精神病的情形有三种情况：1、婚前曾患过精神病，婚后因受某种刺激复发；2、婚前未曾患有精神病，婚后因某种强刺激或外伤造成精神病；3、因精神病遗传而在婚后患精神病。
