释义	法律分析：聚众淫乱罪在主观方面表现为直接故意。即明知会发生危害社会的结果，并且还希望这种结果发生。聚众淫乱罪，是指公然藐视国家法纪和社会公德，聚集男女多人集体进行淫乱活动。凡年满16周岁且具备刑事责任能力的自然人均能构成聚众淫乱罪。法律依据：《中华人民共和国刑法》第三百零一条聚众进行淫乱活动的，对首要分子或者多次参加的，处五年以下有期徒刑、拘役或者管制。引诱未成年人参加聚众淫乱活动的，依照前款的规定从重处罚。
