释义	法律分析：犯法，只要形成法律上的子女关系，那么就会形成抚养和赡养义务。如果对于自已年老的父母，没有或丧失了劳动能力，或者生活不能自理，因而无法独立生活的，作为子女负有扶养义务，有能力扶养却不扶养，致使父母因遗弃被迫自杀的、因生活无着而流落失所的等等，就构成犯罪。法律依据：《中华人民共和国民法典》第二十一条父母对子女有抚养教育的义务;子女对父母有赡养扶助的义务。
