释义	法律分析：关于保证与物的担保的关系是同一债权既有保证又有债务人自己提供的物的担保的，保证人仅对物的担保以外的债权承担保证责任，同一债权既有保证又有债第三人提供的物的担保的，如各自承担的担保责任范围已由合同明确约定，则债权人可以请求保证人或者物的担保人承担担保责任。法律依据：《中华人民共和国民法典》第六百八十三条机关法人不得为保证人，但是经国务院批准为使用外国政府或者国际经济组织贷款进行转贷的除外。以公益为目的的非营利法人非法人组织不得为保证人。
