释义	法律分析: 捡到东西不还达到一定数额可能构成侵占罪。捡拾他人遗忘物，拒绝归还的，属于侵占行为，一般数额达到三千元以上涉嫌侵占罪。侵占罪属于自诉案件，公安局不予立案。可直接向法院起诉。法律依据: 《中华人民共和国民法典》第九百八十五条得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：(一)为履行道德义务进行的给付;(二)债务到期之前的清偿;(三)明知无给付义务而进行的债务清偿。
