血腥视频传播要如何处罚 |

法律分析：传播血腥视频处罚依据如下：
1、传播血腥视频情节较轻微，没有造成严重后果的，一般处以处五日以上十日以下拘留，可以并处五百元以下罚款；
2、但是情节严重，属于明知是宣扬恐怖主义音频视频资料的，构成刑事犯罪，依法追究刑事责任。如果明知是暴恐血腥视频并传播的，则可能涉嫌非法持有宣扬恐怖主义物品罪。

第二十五条 有下列行为之一的，处五日以上十日以下拘留，可以并处五百元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款：
（一）散布谣言，谎报险情、疫情、警情或者以其他方法故意扰乱公共秩序的；
（二）投放虚假的爆炸性、毒害性、放射性、腐蚀性物质或者传染病病原体等危险物质扰乱公共秩序的；
（三）扬言实施放火、爆炸、投放危险物质扰乱公共秩序的。

第一百二十条之六 【非法持有宣扬恐怖主义、极端主义物品罪】明知是宣扬恐怖主义、极端主义的图书、音频视频资料或者其他物品而非法持有，情节严重的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金。
