离婚冷静期是否一定要等30天 |

是的，离婚冷静期是在协议离婚中才有的。
所谓的离婚冷静期，其实就是一对要离婚的夫妻，经过艰难的协商、谈判之后去民政局签字离婚拿离婚证，结果现在至少要签字后的30天后才能拿到离婚证。
如果在这个三十天内，夫妻其中一方要撤回，民政局就不会给离婚证，如果满三十天，其中一方不去领，也被认定为撤回，同样不发离婚证。

《民法典》第一千零七十七条，自婚姻登记机关收到离婚登记申请之日起三十日内，任何一方不愿意离婚的，可以向婚姻登记机关撤回离婚登记申请。
前款规定期限届满后三十日内，双方应当亲自到婚姻登记机关申请发给离婚证；未申请的，视为撤回离婚登记申请。
