释义	法律分析：犯罪嫌疑人被判处刑罚或者免除刑罚的，检察院可以做出不起诉决定。参与赌博的人员，若情节轻微，不构成赌博罪，可以对参与者进行治安管理处罚，也不需要起诉。法律依据：《中华人民共和国刑法》第三百零三条以营利为目的，聚众赌博或者以赌博为业的，处三年以下有期徒刑、拘役或者管制，并处罚金。开设赌场的，处五年以下有期徒刑、拘役或者管制，并处罚金；情节严重的，处五年以上十年以下有期徒刑，并处罚金。
