释义	法律分析：法定犯，“自然犯”的对称，又称“行政犯”。是指并非当然具有侵害社会秩序的性质，大都为适应形势的需要，或者为贯彻行政措施的需要，而特别规定的犯罪。法定犯本身，并非当然具有反社会性与反道义性，只是由于违反行政法规的规定才构成犯罪，故又称行政犯。法律依据：《中华人民共和国刑法》第一条为了惩罚犯罪，保护人民，根据宪法，结合我国同犯罪作斗争的具体经验及实际情况，制定本法。
