释义	夫妻共同债务需要夫妻共同承担，个人债务需要独自承担。夫妻共同债务，顾名思义就是夫妻共同欠下的债务，理应由夫妻共同偿还。如果只约定由一方偿还，然后夫妻约定财产由另一方全部取得，偿还债务的一方也就没有偿还能力，这就是属于侵犯债权人合法权益的行为。因此夫妻债务双方都要承担。【法律依据】《民法典》第一千零八十九条，离婚时，夫妻共同债务应当共同偿还。共同财产不足清偿或者财产归各自所有的，由双方协议清偿；协议不成的，由人民法院判决。
