释义	法律分析：(1)当事人在法定期间内提出撤销仲裁裁决的申请;(2)人民法院受理撤销仲裁裁决申请;(3)依法组成合议庭;(4)在法定期限内作出裁定。法律依据：《中华人民共和国仲裁法》第五十八条第二款法院组成合议庭对撤销仲裁裁决审查核实裁决有无法定撤销的情形后，依法作出撤销或驳回申请的裁定。合议庭能否由审判员和陪审员组成，并无明文规定。笔者认为，鉴于此类案件涉及法院对仲裁的司法审查，为慎重起见，应由审判长和其他审判人员组成合议庭进行审查，而不宜有陪审员参加合议庭审查此类案件。
