释义	刑事犯罪被判刑九个月的,是从犯罪嫌疑人被执行强制措施起算的,在判刑前已经在公安看守所拘押将近九个月实刑的,不再转移到监狱;离开九个月实刑还有两个月以上的,将被转移到监狱。法律依据：《中华人民共和国刑法》第四十五条有期徒刑的期限，除本法第五十条、第六十九条规定外，为六个月以上十五年以下。第四十六条被判处有期徒刑、无期徒刑的犯罪分子，在监狱或者其他执行场所执行;凡有劳动能力的，都应当参加劳动，接受教育和改造。
