释义	兄弟姐妹分房产的协议没有经过公证也是有效的。公证只是对民事法律行为、有法律意义的事实和文书的真实性、合法性予以证明的活动，并不是其合法有效的必经程序。因此分房协议只要符合法定条件就是合法有效的。《公证法》第二条公证是公证机构根据自然人、法人或者其他组织的申请，依照法定程序对民事法律行为、有法律意义的事实和文书的真实性、合法性予以证明的活动。第三十六条经公证的民事法律行为、有法律意义的事实和文书，应当作为认定事实的根据，但有相反证据足以推翻该项公证的除外。
