法律分析：
事实婚姻，指没有配偶的男女，未进行结婚登记，便以夫妻关系同居生活，群众也认为是夫妻关系的两性结合。事实婚姻的构成需要以下条件：
1、男女双方的同居(即男女双方在一起持续、稳定的共同居住)行为始于1994年2月1日以前;
2、同居是以夫妻名义进行的;
3、同居双方1994年以前同居时已经具备结婚的实质要件。
所谓结婚的实质要件即男女双方建立夫妻关系所必须具备的条件，具体包括：
1、双方均达到法定婚龄(男二十二，女二十);
2、双方自愿结婚;
3、双方均无配偶且不属于直系血亲或者三代以内旁系血亲;
4、未患有医学上认为不应当结婚的疾病。因为1994年2月1日之后，已经不再承认事实婚姻。如果没有领取结婚证就生了孩子，最多也只能认为是同居关系。在现在的法律的面前，同居关系是不受保护的。

《中华人民共和国民法典》
第一千零四十七条 结婚年龄，男不得早于二十二周岁，女不得早于二十周岁。
第一千零四十八条 直系血亲或者三代以内的旁系血亲禁止结婚。
第一千零四十九条 要求结婚的男女双方应当亲自到婚姻登记机关申请结婚登记。符合本法规定的，予以登记，发给结婚证。完成结婚登记，即确立婚姻关系。未办理结婚登记的，应当补办登记。
