释义	法律分析: 仲裁也并不都是优点，相比于诉讼，缺点也是显而易见的。首先从救济途径来看，仲裁的一裁终局虽然方便快捷，但没有了再审的监督作用，尽管当事人在法定情况下可以申请撤销仲裁，但一般来讲当事人失去了进一步主张权利的机会。而诉讼本来就是二审终审，当事人不服一审判决的还可以向上级法院申请再审，救济途径相对更广。法律依据: 《中华人民共和国劳动法》第七十七条用人单位与劳动者发生劳动争议，当事人可以依法申请调解、仲裁、提起诉讼，也可以协商解决。调解原则适用于仲裁和诉讼程序。
