释义	法律分析：如果是出于个人原因，交了首付没签合同，退房属于单方面违约，交纳的定金无法退回。如果是出于开发商的原因，交了首付没签合同，购房人可以退房。由开放商双倍返还定金，并返还首付款。法律依据：《城市商品房销售管理办法》第二十四条开发商擅自变更规划、设计的，或者经规划部门批准的规划变更、设计单位同意的设计变更导致商品房的结构型式、户型、空间尺寸、朝向变化，以及出现合同当事人约定的其他影响商品房质量或者使用功能情形的，必须经过购房人同意。否则，开发商构成违约，购房人有权退房。
