明知对方有配偶而与其同居，一般情况下，如果双方以夫妻名义同居，是可以追究对方重婚罪的，但是相关法律并未规定第三者的责任。如果对方以夫妻名义共同居住生活的，涉嫌重婚，可以向人民法院起诉，依法追究对方的刑事责任。起诉人是原配，原配如无能力可报警，由公安机关收集证据移送检察院提起公诉。

《中华人民共和国刑法》第二百五十八条 有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
