释义	据我国相关法律规定，重婚罪可以自诉也可以公诉。重婚罪属于轻微刑事案件，重婚行为侵犯了我国法定的一夫一妻制度，故被害人向公安机关报案的，公安机关应该予以刑事立案侦查，向检察院提交材料后，由检改哪察院向法院提起公诉。对于公安机关不予立案的情形，被害人可以自行向人民法院提起自诉，人民法院应立案受理。法律依据: 《中华人民共和国刑法》第二百五十八条有配偶而重婚塌锋的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
