释义	法律分析：试用期合同跟转正合同可以是同一份,试用期用人单位觉得不合适的,可以提前3天和劳动者沟通,解除劳动合同。一般都是一份劳动合同,在这份劳动合同中注明试用期和转正期具体时间。如果公司分为两个合同也可以的,这不是原则问题。这样就是麻烦一些。法律依据：《劳动合同法》第十条建立劳动关系，应当订立书面劳动合同。已建立劳动关系，未同时订立书面劳动合同的，应当自用工之日起一个月内订立书面劳动合同。用人单位与劳动者在用工前订立劳动合同的，劳动关系自用工之日起建立。
