释义	法律分析：1、如果没有签订书面协议，但实际交付了定金的，所出具的定金收据有法律效力，定金担保有效。 2、未签订合同之前交付的定金往往是立约定金。如果定金给付方只是单纯的不想再签订合同，则定金是不能要求退还的。当然如果是因不可归责于定金给付方和定金接收方的原因(如限购政策的突然出台)导致合同客观上无法签订的，这个定金是可以退还的。法律依据：《中华人民共和国民法典》第五百八十六条当事人可以约定一方向对方给付定金作为债权的担保。定金合同自实际交付定金时成立。
