法律依据：《关于审理民间借贷案件适用法律若干问题的规定》 第二十六条 如果约定的利率超过年利率36%，超过部分无效，借款人可以要求出借人归还已收取的超过年利率36%部分的利息。由此可见，高利贷是违法的，不受法律保护，出借人已收取高额利息的，还应当返还。
