基本农田可以建养殖场嘛 |

法律分析：一般农田可以建养殖场，只要不破坏耕地的耕作层，不破坏耕种植条件，不占用基本农田，土地承包人可以自主决定将农田用于养殖业。养殖用地属于农业用地，其上建造养殖用房不属于改变土地用途的行为。由《关于促进规模化畜禽养殖有关用地政策的通知》得知，鼓励利用废弃地和荒山荒坡等未利用地修建养殖场，坚持尽量不占或少占耕地的原则。如果确需占用耕地需要向有关部门申请，经乡镇人民政府同意后向县级有关部门备案后可以建设养殖场。所以基本农田保护区内是不可以建设养殖场的，基本农田保护区以外的农用地，经过相关部门批准是可以建设养殖场的。
法律依据：《中华人民共和国城乡规划法》 第六十四条 未取得建设工程规划许可证或者未按照建设工程规划许可证的规定进行建设的，由县级以上地方人民政府城乡规划主管部门责令停止建设;尚可采取改正措施消除对规划实施的影响的，限期改正，处建设工程造价百分之五以上百分之十以下的罚款;无法采取改正措施消除影响的，限期拆除，不能拆除的，没收实物或者违法收入，可以并处建设工程造价百分之十以下的罚款。
