释义	法律分析：不可抗力的认定应当从三方面判断，分别是指不能预见、不能避免并不能克服的客观情况。不能预见指的是在现有的社会经济的情况下无法预测准确发生的事情，不能避免指的是即使能够预测但是该事件没有办法规避，不能克服指的是事件发生后，没有其他办法能够处理的。对于因不可抗力不能履行民事义务的，义务人则不承担民事责任。法律依据：《中华人民共和国民法典》第一百八十条因不可抗力不能履行民事义务的，不承担民事责任。法律另有规定的，依照其规定。不可抗力是不能预见、不能避免且不能克服的客观情况。
