法律分析：按照法律规定，劳动关系自用工之日起建立，如果用人单位自用工之日起一个月内没有和劳动者签订劳动合同的，若是用人单位的原因，则需从第二个月开始给予双倍工资，若是劳动者的原因，则一个月内可以直接辞退。
法律依据：《中华人民共和国劳动合同法》第七条 用人单位自用工之日起即与劳动者建立劳动关系。用人单位应当建立职工名册备查。
