释义	吃空饷是指机关事业单位在编任职人员违规领取薪水、津贴、补贴等待遇或由单位违规交纳社会保险费，离休、退休、离任人员及失踪、丧命人员亲属、遗属或他人直接或间接从单位、财政或社保经办组织违规领取薪水、津贴、补贴、补贴费、离退休费、离任生活费或养老金等待遇。法律依据：《最高法关于解决受贿刑事案件适用法律若干问题的意见》第六条国家工作人员利用职务上的便利为请托人谋取利益，要求或者接受请托人以给特定关系人安排工作为名，使特定关系人不事实上工作却获取所谓薪酬的，以受贿论处。
