开票方与合同方不一致
释义
法律主观：
合同签订人与开票人不一致一般并不影响合同效力，开票如果是合同约定的应当由 合同当事人 亲自履行的义务的，此时必须经过合同当事人同意，才能够由第三人来履行。如果不是合同规定的义务，可以由他人进行。根据《民法典》第四百六十五条依法成立的合同，受法律保护。依法成立的合同，仅对当事人具有 法律约束力 ，但是法律另有规定的除外。第五百二十三条当事人约定由第三人向债权人履行债务，第三人 不履行债务 或者履行债务不符合约定的，债务人应当向债权人 承担违约责任 。
