劳动合同的生效要件：1.双方当事人具备相应的民事行为能力；2.劳动合同订立程序合法，即在劳动合同订立过程中必须严格遵守合法以及平等自愿、协商一致等原则；3.劳动合同的内容合法，不得违反法律的强制性规定，不得违反公序良俗；4.劳动合同需具备法律所要求的形式。
法律依据：
《中华人民共和国劳动合同法》 第十六条 劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。劳动合同文本由用人单位和劳动者各执一份。
