释义	房屋买卖合同若是各方真实意思表示，不违反法律、行政法规的强制性规定，即属于合法有效的合同，各方应依约享有权利、履行义务。买方购房资格审查源于我国特有的房地产限购政策，显然不属于上述五种导致合同无效情形的任何之一，因此买方不具备购房资格并不必然导致房屋买卖合同无效。法律依据：《中华人民共和国民法典》第一百四十三条具备下列条件的民事法律行为有效：（一）行为人具有相应的民事行为能力；（二）意思表示真实；（三）不违反法律、行政法规的强制性规定，不违背公序良俗。
