激情犯罪的定义与量刑
释义
法律分析：指因被害人不当的言词或行为刺激而产生强烈的、短暂的激情,自我控制能力减弱,并且在不当的言词或行为之时或十分接近的时间内立刻实施犯罪行为。犯罪的行为往往是在被告人爆发式的、强烈的情绪状态下所实施的。其犯罪过程具有时间短暂，迅猛激烈、难以控制的特点,刑事立法给予从宽处罚的犯罪。
法律依据：《中华人民共和国刑法》 第二百三十二条 故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。
