释义	法律分析: 按照有关规定，国家建设征用土地要提前安排迁坟的，而且国家还对迁坟给予一定的费用。如果拒绝迁移的，责任由当事人本人承担；如果有人故意破坏坟墓，要赔偿损失并予以治安处罚。法律依据: 《中华人民共和国治安管理处罚法》第六十五条有下列行为之一的，处五日以上十日以下拘留；情节严重的，处十日以上十五日以下拘留，可以并处一千元以下罚款：（一）故意破坏、污损他人坟墓或者毁坏、丢弃他人尸骨、骨灰的；（二）在公共场所停放尸体或者因停放尸体影响他人正常生活、工作秩序，不听劝阻的。
