羁押必要性审查的法律规定：《中华人民共和国刑事诉讼法》第九十五条，犯罪嫌疑人、被告人被逮捕后，人民检察院仍应当对羁押的必要性进行审查。不需要继续羁押的，应当建议予以释放或者变更强制措施。
