释义	立案侦查后追诉期已到的案件会被撤销，我国刑法根据罪刑相适应原则，以犯罪的法定最高刑为标准，规定了4个档次的追诉时效。根据《刑法》第87条的规定，犯罪经过下列期限不再追诉：1、定最高刑不满5年有期徒刑的，经过5年;2、定最高刑为5年以上不满10年有期徒刑的，经过10年;3、定最高刑为10年以上有期徒刑的，经过15年;4、定最高刑为无期徒刑、死刑的，经过20年。如果20年以后认为必须追诉的，须报请最高人民检察院核准。
