释义	房屋承租人将房屋转租给次承租人，已经取得房屋出租人的书面或者口头同意，依此订立的合同应认定为有效。房屋承租人将房屋转租给次承租人，未取得房屋出租人的同意，但房屋出租人知道或者应当知道该房屋承租人将房屋转租给次承租人未作反对表示的(默示)，应视为已经取得了房屋出租人的同意，该房屋转租合同有效。法律依据：《中华人民共和国民法典》第一百四十三条具备下列条件的民事法律行为有效：（一）行为人具有相应的民事行为能力；（二）意思表示真实；（三）不违反法律、行政法规的强制性规定，不违背公序良俗。
